1. Acceptance of Terms
Welcome to HaciGroup ("HaciGroup," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the HaciGroup website, the NELA Ride mobile applications (Driver App and Rider App), and any related services (collectively, the "Platform" or "Services").
PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MAY NOT USE THE PLATFORM.
These Terms include a mandatory arbitration provision and class action waiver in Section 12, which affect your rights to resolve disputes with us.
2. Description of Services
HaciGroup is a California nonprofit organization dedicated to building community-owned technology. NELA Ride is a community transportation platform that connects individuals seeking transportation ("Riders") with volunteer drivers ("Drivers").
PLATFORM NATURE:
HaciGroup is a technology platform, NOT a transportation carrier. We do not employ drivers, own vehicles, or provide transportation services directly. Drivers are independent contractors or volunteers who choose to use our Platform to offer rides. We are not responsible for the acts or omissions of any Driver or Rider.
3. Eligibility & Accounts
- Age: You must be at least 18 years old to create an account and use the Platform.
- Account Security: You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized use of your account.
- Accuracy: You agree to provide accurate, current, and complete information during registration and to keep it updated.
4. Driver Specific Terms
If you use the Platform as a Driver, you represent, warrant, and agree that:
- You possess a valid driver's license and are authorized to operate a motor vehicle in your jurisdiction.
- You own or have the legal right to operate the vehicle you use.
- You maintain valid vehicle insurance that meets or exceeds state requirements.
- You will not discriminate against Riders based on race, religion, national origin, disability, sexual orientation, sex, marital status, gender identity, or age.
- You are an independent contractor, not an employee of HaciGroup.
5. Rider Specific Terms
If you use the Platform as a Rider, you agree that:
- You will treat Drivers and their vehicles with respect.
- You will not transport illegal items, hazardous materials, or weapons.
- You are responsible for the conduct of any guests you bring on a ride.
- Minors may only ride if accompanied by an adult guardian.
6. Payments & Contributions
NELA Ride operates on a community contribution model.
- Contributions: Payments made by Riders are voluntary contributions to support the community driver and the platform.
- Distribution: Generally, 85% of the contribution goes to the Driver and 15% to HaciGroup to cover platform maintenance and operations.
- Refunds: Contributions are non-refundable once a ride is completed, unless otherwise determined by HaciGroup in its sole discretion.
- Taxes: Drivers are solely responsible for reporting and paying all applicable taxes on income received through the Platform.
